JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-08-2022 The present petition has been filed for restoring a writ petition bearing C.W.J.C. No. 6119 of 2010 which has stood dismissed qua the Respondent No. 7 on account of noncompliance of the peremptory order dated 12.12.2013. The learned counsel for the petitioner has submitted that steps could not be taken earlier for restoration of the aforesaid writ petition, which had stood dismissed qua the
Patna High Court MJC No.1344 of 2022(3) dt.24-08-2022 2/2 Respondent no. 7 on account of the son of the petitioner suffering from cancer, however, now the petitioner is in a position to comply with the peremptory order dated 12.12.2013. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for restoration of the aforesaid writ petition bearing CWJC No. 6119 of 2010 qua the Respondent No.7, subject to compliance of the peremptory order dated 12.12.2013 passed in CWJC No. 6119 of 2010 within a period of four weeks from today, by physical mode. The present petition stands disposed off.
