2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 323, 324, 307, 379, 448, 506 and 506 of the Indian Penal Code.

3. As per prosecution case, this petitioner is alleged to have assaulted on the head of informant by means of dab.

4. It is submitted by learned counsel appearing on behalf of the petitioner that both parties are patidars and there is admitted land dispute between them, due to which this false and concocted case has been lodged. It is further submitted that injuries allegedly caused by this petitioner have been opined to be simple in nature. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has opposed the prayer

Patna High Court CR. MISC. No.43637 of 2024(2) dt.23-07-2024 2/2 for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances, nature of injuries sustained by the injured and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan, in connection with Bhagwanpur Hat P.S. Case No. 274 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
