JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2018 The petitioner is in custody since 16.5.2018 in connection with Hajipur Sadar P.S. Case No. 245 of 2018, registered for offences punishable under Sections 302/120(B) of the Indian Penal Code.
Informant is the son of the petitioner whereas the deceased is the daughter of the petitioner and allegation as per F.I.R. is that while the deceased was coming along with his brother on motorcycle, someone from behind shot her dead and later on, the name of the petitioner transpired showing that the petitioner was not happy with the relationship of his daughter with others and as such she was killed.
Submission of learned counsel for the petitioner is that
Patna High Court Cr.Misc. No.45794 of 2018 (3) dt.12-09-2018 2/3 except suspicion, there is absolutely nothing against the petitioner and he is in custody since 16.5.2018.
Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that the two accused persons were arrested and they have confessed their guilt and the mobile of the petitioner shows that he was talking with the other accused persons. Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000, (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 245 of 2018, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event
Patna High Court Cr.Misc. No.45794 of 2018 (3) dt.12-09-2018 3/3 of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
