2. This application has been filed on behalf of the petitioner who is seeking regular bail in connection with NDPS Case No. 07 of 2025 arising out of Excise P.S. Case No. 60 of 2025 registered for the offence under Section 20(b)(ii)©, 25 and 29 of the NDPS Act.

3. As per the prosecution case, there is recovery of about 64 kg of ganja from a car standing in front of the cattle shed of the petitioner.

4. The petitioner is in custody since 14.02.2025.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and the car from which the recovery was made does not belong to him and the same belongs to another person of the village namely Om Prakash

Patna High Court CR. MISC. No.42063 of 2025(3) dt.03-09-2025 2/2 Kumar. He further submits that the Ganja belonged to Om Prakash Kumar who is an smuggler and he has deliberately parked his car in front of the cow shed of the petitioner. He also submits that Om Prakash Kumar is still absconding.

6. Considering the huge recovery of Ganja, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. The Superintendent of Police, Begusarai is directed to take all steps for arresting the main accused/co-accused Om Prakash Kumar and file a compliance report in this Court after on or before the next date of hearing.

9. List this case after four weeks for perusal of the report.

10. Let a copy of this order be communicated to the Superintendent of Police, Begusarai through FAX for its compliance.
