The petitioner is apprehending his arrest in connection with Khutauna P.S. Case No. 146 of 2015 for the offences instituted under Section 7 of the E.C. Act.
As per prosecution case, it is alleged by the informant that on secret information of holding and black marketing of rice of the FCI, the informant with the help of police party reached at the house of this petitioner and when the police entered in the courtyard of the house 550 bags of rice were found there and 66 empty gunny bags baring Mark of FCI and 300 plastic bags bearing mark of double Hathi, six pieces of FCI wrapper and wrapper of other mark of Sri Lakshmi Ganpati Mordern rice mill
Patna High Court Cr.Misc. No.27354 of 2016 (2) dt.12-07-2016 Singpur, one sewing machine, four register one Bolero vehicle, unloaded rice from FCI bags being packed in plastic bag were recovered.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has falsely been implicated in the present case. The only material is the recovery of 66 empty bags having a mark of FCI. The petitioner is a dealer in food grains and such bags of FCI are available in the open market which is used for the transportation of food grains. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Khutauna P.S. Case No. 146 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Devesh Kumar, Judicial Magistrate, Jhanjharpur (Madhubani), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
