Heard learned counsel for the petitioners and the learned A.P.P. for the State.
Petitioners are languishing in judicial custody since 17.06.2017 in connection with Madhepura P.S. Case No. 386 of 2017 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, as lodged by the police personnel, is that six persons were coming on three motorcycles in
Patna High Court Cr.Misc. No.39864 of 2017 (2) dt.22-08-2017 2/2 suspicious condition and while they were being stopped, they proceeded towards a bamboo-clump to conceal cartons, which they were holding. Four persons were apprehended and from the possession of the petitioner no. 1, 9 litres and petitioner no.2, 8.625 litres of foreign liquor was recovered. It is submitted by the learned counsel for the petitioners that they are innocent, bear no criminal history, are college students and have been falsely implicated by the police. However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let the petitioners, named above, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 3rd -cumSpecial Judge, Excise Act, Madhepura in connection with Madhepura P.S. Case No. 386 of 2017.
