The petitioners apprehend their arrest in connection with Parsa P.S. Case No. 95 of 2013 registered under Sections 304(B) and 201/34 of the Indian Penal Code.
The accusation is of killing of Debrati Devi, nice of the informant, by her husband and in-laws due to non-fulfillment of demand of dowry within four years of marriage and her dead body was disposed of.
Learned counsel for the petitioners submits petitioners happen to be the mother-in-law and brother-in-law of the deceased and they have falsely been implicated in this case. It is further
Patna High Court Cr.Misc. No.42581 of 2015 (2) dt.08-10-2015 submitted that, in fact, deceased died due to diarrhea and the informant was given to the Maika people of the deceased thereafter the dead body was disposed of.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer of the petitioners for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
