This application is for grant of regular bail in connection with Ahiyapur P.S.Case No.511 of 2018,for the offences under Sections 367, 382/34 of the Indian Penal Code. Allegation against the petitioner is of snatching the chain and bag from the informant and on chase he was arrested and the bag was recovered.
Submission of the learned counsel for the petitioner is that he was not arrested at the spot and he has no criminal antecedent. He is in custody since 21.5.2018. Heard learned A.P.P. also.
Having heard both sides and in view of allegation, at this stage, I am not inclined to grant bail to the petitioner,
Patna High Court Cr.Misc. No.46434 of 2018 (3) dt.17-09-2018 2/2 however, once the charge is framed against the petitioner, he will be released on bail in connection with Ahiyapur P.S.Case No.511 of 2018 dated 20.5.2018 to the satisfaction of the learned CJM, Muzaffarpur.
With the aforesaid observation, this application is disposed of.
