2. The accused/petitioner seeks bail in connection with S.T. No.613 of 2024/Tr. No.2909 of 2024 arising out of Pirpainty P.S. Case No.375 of 2022 registered for the offences punishable under Sections 147, 148, 149, 120-B, 302 of the Indian Penal Code (in short 'IPC') and Section 27 of the Arms Act.
3. The accused/petitioner is named in the FIR and is in custody since 04.05.2025.
4. As per FIR, named and unknown co-accused persons committed murder of nephew and brother of the informant.

It is submitted by learned counsel appearing for petitioner that from the facial perusal of FIR, it can be gathered safely that merely suspicion has been raised against the petitioner by the informant, who is not the eye-witness of the occurrence. It is submitted that the police after investigation submitted final form against petitioner and did not sent up this petitioner for facing the trial. It is also pointed out that this case is based upon circumstantial evidence, as petitioner was engaged with ploughing of maize crop of deceased and the motorcycle of co-accused Lalu Thakur was found near to the place of occurrence and mere on the basis of said suspicion, the petitioner has been implicated with present crime in question. While concluding argument, it is submitted that the petitioner is a man of clean antecedent.

Mrs. Suman Kumari Singh, learned APP while opposing the prayer of bail submitted that the witnesses stated during course of investigation qua involvement of this petitioner with present crime in question. However, she fairly conceded that the police after investigation submitted final form against petitioner.

In view of aforesaid factual submissions and by taking note of fact as save and except suspicion as raised against petitioner by informant prima facie nothing incriminating surfaced during course of investigation as to connect him with present crime in question, coupled with the fact petitioner, being a man of clean antecedent, remains in custody since 04.05.2025, accordingly, the petitioner, abovenamed, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-15th, Bhagalpur in connection with S.T. No.613 of 2024/Tr. No.2909 of 2024 arising out of Pirpainty P.S. Case No.375 of 2022, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short 'CrPC')/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS').
