The petitioner being the mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Accusation is of killing the daughter of the informant after seven months of marriage for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that subsequently the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-2 to the petition. The informant has been declared hostile during trial of

Patna High Court Cr.Misc. No.43013 of 2015 (2) dt.14-10-2015 2/2 the husband of the victim where he has not supported the prosecution case.

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Kako P.S. Case No.42 of 2014, pending before the learned ACJM Jehanabad.

With the above observation, this application is, accordingly, disposed off.
