2. The petitioners seek regular bail in a case registered for offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Learned counsel for the petitioners submits that petitioners are named in the F.I.R., but only suspicion has been raised against them on the ground that earlier, they had threatened the deceased to kill and had also made attempt to commit his murder by throwing poison in well. Admittedly, none has seen the actual killing of deceased and except aforesaid material, there is nothing against these petitioners. Similarly situated four co-accused persons have already been

Patna High Court CR. MISC. No.39939 of 2025(2) dt.08-08-2025 2/2 granted bail by a coordinate Bench of this Court, vide order dated 01.03.2016 passed in Cr.Misc. No. 9673 of 2016 (Annexure P/4). Petitioners are in custody since 09.05.2025.

4. Learned A.P.P. for the State vehemently opposed the bail petition.

5. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, Patna in connection with Belchhi P.S. Case No. 57 of 2015.
