JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 376 of the Indian Penal Code and Section 6 of the Protection of Children From Sexual Offences Act.
The prosecution case is that while the daughter of the informant Kumari Mahima Mehta was returning home from the school this petitioner took her to anganbari centre and ravished her.
It is submitted by learned counsel for the petitioner that there is no eye witness to the occurrence. Moreover the medical opinion does not corroborate the accusation.
Considering the nature of accusation, let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six
