JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Pirbahore P.S. Case No. 554 of 2019 registered for the offence punishable under Sections 20 and 22 of the N.D.P.S. Act. Allegedly, from the petitioner's possession 5 gm of heroin was recovered by the police. Other accused persons were also apprehended with this petitioner.

Learned counsel appearing on behalf of the petitioner has submitted that other co-accused similarly situated have been allowed regular bail by this Court by an order dated 03.03.2020 passed in Cr. Misc. No.14741 of 2020 and

Patna High Court CR. MISC. No.2756 of 2021(2) dt.25-01-2021 2/2 03.06.2020 passed in Cr. Misc. No. 12619 of 2020. The petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 02.06.2020 passed in Cr. Misc. No. 16120 of 2020.

Considering the submission made on behalf of the petitioner that similarly circumstanced co-accused have been allowed regular bail by this Court and the petitioner is in custody since 23.10.2019, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV, Patna in Pirbahore P.S. Case No. 554 of 2019.
