Anis Akhtar, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Isuapur P. S. Case No. 126 of 2020, dated 24.07.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Regard being had to the fact that the petitioner was earlier made accused in two cases of similar nature in which though he has been granted bail, I am not inclined to exercise my discretion for grant of

Patna High Court CR. MISC. No.275 of 2021(2) dt.23-06-2021 2/2 anticipatory bail to him.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seek bail, that shall be considered on its own merits and taking into account the fact that nothing has been recovered from his possession and that he has been made accused in this case on vague grounds, and shall pass orders in accordance with law, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court. The application stands disposed off.
