JUSTICE SANJAY PRIYA ORAL ORDER 11-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Raniganj P.S. Case No. 247 of 2002 (Sessions Trial No. 153 of 2018) instituted for the offence under Sections 376, 302, 201 of the Indian Penal Code. Counsel for the petitioner submits that police after investigation has not sent up petitioner for trial. The court below after differing with the final form has taken cognizance against the petitioner along with other co-accused persons for the offence under Sections 302 and 201 of the Indian Penal Code. Counsel for the petitioner further submits that other co-accused against whom the police has submitted final form, has already been granted bail by a coordinate Bench of this Court vide order dated 27.09.2018 passed in Cr. Misc. 44054 of 2018.

No.52925 of 2018 (4) dt.11-10-2018 2/2 In the written report there is specific allegation against Naresh Sah of committing illegal act with daughter of the informant and thereafter killing her. Allegation against the petitioner is that he has helped Naresh Sah in concealing the dead body.

Petitioner is in custody since 6.7.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional District & Sessions Judge, Araria, in connection with Raniganj P.S. Case No. 247 of 2002 (Sessions Trial No. 153 of 2018), subject to the condition that both the bailors will be the close relatives of the petitioner.
