Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor assisted by learned counsel for the informant.
On account of encroachment of passage by means of harvested paddy plant which has been resisted for which, it has been alleged that accused Shambhu Yadav fired over informant Laltu Kumar. His own brother Nawal Kumar Yadav, cousin brother Kailu (deceased), Tunntun Yadav came in rescue whereupon accused Deo Narain ordered to kill. Gautam Yadav gave spade blow over head of Kailu Yadav, Kailu Yadav sustained injury and fell down. Thereafter, Shambhu gave iron rod blow over head of Nawal Kumar Yadav. Shambhu gave spade blow over head of Tuntun Yadav. Then it has been alleged that Shyamal Yadav, Harballav (petitioners) later on assaulted all of them with lathi. Patna High Court Cr.Misc. No.47910 of 2017 (3) dt.09-11-2017 which create doubt so far complicity of these petitioners are concerned, consequent thereupon, petitioners Harballav @ Harvallav Yadav @ Harballav Yadav, Shyamal Yadav are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned ACJM, IIIrd, Khagaria in connection with Beldaur P.S. Case No.119/2017.
