The petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 20.03.2021, charges have been framed and has antecedent of three cases.

The learned counsel for the petitioner submits that petitioner has been acquitted in Sherghati P. S. Case No.126 of 2001, as such, presently there is only two cases pending against the petitioner apart from the present one.

Allegation is of looting the bank of Rs.14,42,170/- by six unknown criminals. Further the criminals even looted some

The learned counsel for the petitioner submits that the name of ths petitioner transpired in the confessional statement of Pappu Kumar and thereafter, it is alleged that Rs.1,10,000/- from his house. The learned counsel for the petitioner submits that the notes which is alleged to have been recovered was wrapped on which logo of Axis Bank was embossed. It is submitted that the alleged recovered amount belonged to the petitioner. It is further submitted that the Gramin Bank was looted and the alleged money which was recovered was of the Axis Bank. It is also submitted that petitioner was not put on T. I. Parade.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charges have been framed and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nardiganj P. S. Case No.40 of 2021, subject to condition that one of the bailors shall be the wife of

In the event, if the petitioner does not appear on two consecutive dates, the learned Court below shall forthwith cancel his bail bonds. The application stands allowed.
