JUSTICE SUDHIR SINGH ORAL ORDER 29-06-2016 This application has been filed for modification of the order dated 10.3.2016 passed in Cr. Misc. no. 58051 of 2015 for extension of time for surrender in the court below. It is stated in the petition that petitioner was working in a remote rural area at Chhatishgadh and due to bad phone network he could not receive any information in time. As soon as he received the information, he rushed to Muzaffarpur for surrender. There is no deliberate laches on the part of the petitioner.

In view of the ground mentioned above, this application is allowed and petitioner is directed to surrender in the court below, i.e, learned Sub-Judge-cum-Additional Chief Judicial Magistrate, Muzzarpur within a further period of two weeks from the date of receipt/production of a copy of this order in connection with Mushahari P. S. Case no. 173 of 2015.

Patna High Court Cr.Misc. No.25557 of 2016 (2) dt.29-06-2016 2/2 The modification application is, accordingly, disposed of.
