Petitioner is languishing in custody since 11.05.2017 in connection with Rajauli P.S. Case No. 107 of 2017 for offences punishable under Sections 366(A), 370(A) of the Indian Penal Code.

The prosecution case, as lodged by the District CoCoordinator, Tatbasi Samaj Nyas, Nawada, is that she got

Patna High Court Cr.Misc. No.44067 of 2017 (3) dt.21-11-2017 2/3 information that a marriage is being performed in the temple in which the bride is a minor. Thereafter the matter was reported to the police and accordingly, the F.I.R. was lodged and it was found that the marriage of the victim girl Sabuja Kumari who was a minor had been performed with the petitioner. It has been submitted by the learned counsel for the petitioner that he is innocent and he is an adopted son of Rinki Devi, bears no criminal antecedent and that it was family consent of both the parties that this marriage was being solemnized. He submits that Rinki Devi, mother of the petitioner, has already been granted the privilege of bail by a co-ordinate Bench of this Court in Cr. Misc. No. 32991 of 2017 on 20.07.2017. He submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the
