2. The petitioners apprehend their arrest in a case registered for the offence under Sections 30(a), 34, 36 of Bihar Prohibition and Excise Act and Sections 25(1-B), 26 of the Arms Act.
3. As per F.I.R., 20 liters of country-made Mahua liquor as well as one country-made Katta with two live cartridges have been recovered from an open place.
4. It is submitted on behalf of petitioners that no incriminating article has been recovered from the conscious possession of these petitioners and have been falsely implicated
Patna High Court CR. MISC. No.46808 of 2024(2) dt.24-07-2024 2/2 in this case only on suspicion, whereas petitioners have got no concern with the alleged recovery. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the nature of accusation and clean antecedent, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna city, Patna in connection with Fatuha P.S. Case No. 672 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
