The petitioner seeks bail in Baniyapur P. S. Case No. 21 of 2018 instituted for the offence under Section(s) 37( c) of Bihar Prohibition and Excise Act, 2016 and Sections 413, 414 of the IPC and Section 25(1-b)/A/26 of the Arms Act. Petitioner is in custody since 27.1.2018.

It is alleged that one country made pistol and four live cartridges have been recovered from possession of the petitioner.

Learned counsel for the petitioner has submitted that petitioner has criminal antecedent as mentioned in para 3 of the bail petition. It has further been submitted that petitioner is on bail in all those case.

No.47926 of 2018(4) dt.10-10-2018 2/2 Keeping in view the period of custody already undergone by the petitioner. let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.-VI Saran at Chapra, in connection with Baniyapur P. S. Case No. 21 of 2018, Excise Trial no. 1683 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner. The petitioner will remain present on every date of trial and absence of petitioner on two consecutive dates without valid reason will amount to cancellation of his bail bond.
