The petitioner apprehends his arrest in Hajipur Town P.S. Case No. 661/2014, registered for the offences punishable under Section 436, 379, 324, 307, 353 and other sections of the Indian Penal Code. Later on, Section 302 of the I.P.C. was added. The informant alleged that Md. Islam son of Md. Sabre Alam was killed by Md. Iqbal Qraisi and his son and the dead body was lying in front of the house of the deceased. Many persons came and ransacked the house. The police also came there. The deceased was traceless since 01.08.2014, but his dead body was found on 03.08.2014. The petitioner was also member of that mob which caused the death of the deceased and concealed the dead-body.

Patna High Court Cr.Misc. No.42981 of 2015 (3) dt.09-12-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

The petitioner, if so advised surrenders before the court below, learned court below shall consider the prayer for regular bail of the petitioner, taking into consideration that similarly situated co-accused Md. Ekbal @ Md. Iqbal Quraisi has already been granted regular bail.
