The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-A) b (a)/26/35 of the Arms Act.

The prosecution case is that the informant being the Officer-in-charge of Dawath Police Station received information that illegal arms were carried out in a black Safari vehicle. The vehicle was intercepted but the driver tried to escape. On chase the vehicle was seized and from the vehicle one country made rifle, half built bolt of rifle and one passed in the name of the petitioner were recovered.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.27128 of 2016 (2) dt.04-07-2016 2/2 petitioner that the petitioner is the owner of the vehicle and the vehicle in question was given by the petitioner to one Pradeep Singh on rent. Admittedly the petitioner was not present at the time of seizure and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Dawath P.S. Case No. 115 of 2015 pending in the court of learned Sub-divisional Judicial Magistrate, Bikramganj, Rohtas.
