The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504/34 of the Indian Penal Code and 3(ii) (x) of the S.C./S.T.(Prevention of Atrocities) Act.
The prosecution case is that on 21.04.2015 at 3.00 A.M. neighbours of the informant raised alarm that the theft was committed in their houses. Subsequently, when the grand son of the informant Rabi Paswan was returning home petitioner nos. 1 and 2 intercepted and started blaming him of committing theft thereafter they abused and
Patna High Court Cr.Misc. No.42842 of 2015 (2) dt.14-10-2015 assaulted him.
It is submitted by the learned counsel for the petitioners that for petty dispute accusation has been levelled. For the occurrence of 22.04.2015 at 6.00 P.M. the First Information Report was registered on 23.04.2015 at 4.30 P.M. and reached to the court of learned Sub-Divisional Judicial Magistrate on 27.04.2015 which suggests that First Information Report was registered by ante dating. It is submitted that informant's grand son has not received any injury.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 64 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
