The petitioner apprehends his arrest in Bihta P.S. Case No. 171/2016 registered under Sections 366/366A of the Indian Penal Code.
The informant made allegation that the petitioner kidnapped his minor daughter. It is submitted that the victim is major and she has made her statement under Section 164 Cr.P.C. wherein she disclosed that she voluntarily left her house and thereafter called Dipak (petitioner) and they went to Punjab. The victim disclosed her age to be 18 years. The victim herself denied the allegation of her kidnapping.
Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt
Patna High Court Cr.Misc. No.28040 of 2016 (2) dt.02-09-2016 2/2 / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur in Bihta P.S. Case No. 171/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
