JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-01-2019 It appears that this application has already been dismissed as withdrawn in respect of the petitioner nos.2 and 3, namely, Banti Singh alias Ranjeet Singh and Birendra Singh alias Birendra Pratap Singh, respectively, vide order dated 20.09.2018 passed by this Court. As such, now, only the prayer of the petitioner no.1, namely, Niraj Singh alias Niraj Kumar Singh alias Tinku Singh, for grant of anticipatory bail is being considered. Heard.

The petitioner no.1, namely, Niraj Singh alias Niraj Kumar Singh alias Tinku Singh, apprehends his arrest in connection with Bhabua Police Station Case No.386 of 2018 registered under Sections 147, 148, 149, 323, 341, 324, 307, 379, 504 and 506 of the Indian Penal Code and, later on, added Section 27 of the Arms Act,

Patna High Court Cr.Misc. No.50220 of 2018(3) dt.31-01-2019 2/2 pending in the court of the Chief Judicial Magistrate, Kaimur at Bhabua.

The accusation is that the petitioner no.1, namely, Niraj Singh alias Niraj Kumar Singh alias Tinku Singh, along with others surrounded the informant and, at that time, the petitioner no.1, namely, Niraj Singh alias Niraj Kumar Singh alias Tinku Singh caused injury at the head of the informant through iron rod. Considering that while the injury, as found on the head of the informant, is simple in nature but the other injuries, as found on the person of the informant, are grievous in nature, I am not inclined to grant anticipatory bail to the petitioner no.1, namely, Niraj Singh alias Niraj Kumar Singh alias Tinku Singh. Accordingly, the prayer of the petitioner no.1, namely, Niraj Singh alias Niraj Kumar Singh alias Tinku Singh, for grant of anticipatory bail stands rejected. However, the petitioner no.1, namely, Niraj Singh alias Niraj Kumar Singh alias Tinku Singh, is directed to surrender before the trial court and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
