Petitioner apprehends arrest in connection with Excise Case No. 185 of 2020 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. None of the witnesses has taken the name of this petitioner. The alleged recovery said made from one Shashi Kant Gupta. Petitioner has no criminal antecedent.

No.51204 of 2021(2) dt.08-04-2022 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of his personal bond to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Excise Case No. 185 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C.
