2. The petitioner has preferred this application for grant of anticipatory bail in connection with Parbatta (Maraiya) P.S. Case No. 353 of 2022, G.R No. 2258/2022 dated 13.08.2022 registered for the offences punishable u/s 341, 323, 307, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner and the two co-accused persons are of assaulting the informant with lathi and danda. When his son protested, they also assaulted him on his head causing head injury and the blood oozing out from his son's head.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.45485 of 2023(7) dt.17-02-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation allegation against the petitioner. From perusal of the injury report it appears that all injuries are simple in nature. The petitioner has no criminal antecedent mentioned in Para 3 of the bail application.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the injury is found to be simple in nature, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 353 of 2022, G.R No. 2258/2022, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. This application stands allowed.
