The petitioners apprehend their arrest in Baruraj P.S. case No. 18 of 2016 under Section 304B, 201, 34 of the Indian Penal Code.
The informant alleged that he married his daughter, Rinku Kumari, with Mukesh Mahto on 23.06.2013. On 09.03.2016 he got information that his daughter was killed and her one year son may also be killed by the accused persons. It is submitted that the petitioners are father-in-law and mother-in-law of the deceased. The informant, of course, has named the petitioners but no specific allegation is made against them. The petitioners were living separately from their son and
Patna High Court Cr.Misc. No.27002 of 2016 (3) dt.01-09-2016 2/2 daughter-in-law. During the period of three years, while the daughter of informant was living in her Sasural, she never made any complaint about the ill treatment at the hands of the petitioners Considering the facts aforesaid and the fact that petitioners are father-in-law and mother-in-law of the deceased and no specific allegation is made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate (West), Muzaffarpur in Baruraj P.S. Case No. 18 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
