JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-09-2015 The matter has been listed out of turn on the prayer of learned counsel for the petitioners since the petitioner no.4 has to file nomination as he is contesting assembly election. A supplementary affidavit to that effect has been filed.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 452, 341, 323, 353, 427, 506, 379/ 511/34 of the Indian Penal Code.

The accusation is of making attempt to rob the revenue collected by the electric supply office, Chakai when

Patna High Court Cr.Misc. No.42394 of 2015 (2) dt.24-09-2015 2/3 on protest being made the Junior Engineer, Electric Supply Department, Chakai was assaulted and documents were snatched.

It is submitted by learned counsel for the petitioners that the informant was illegally collecting money from simple villagers and when he was taken to the Chakai police station on 25.07.2015 where executed bonds but he got himself released somehow and then lodged the present case on 25.07.2014 at 4.15 PM when the written report was submitted on 26.07.2015 and the case was registered on 28.07.2015 which reached to the court of learned JM, on 30.07.2015. Moreover, the accusation is omnibus and general. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the delayed lodging of the case and delayed reaching of the FIR to the court which clouds the bona fide of the accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Jamui
