The petitioner seeks pre-arrest bail in connection with Kahalgaon P.S. Case No. 111/2015 registered under Sections 363, 366-A/34 of the Indian Penal Code. It is contended that similarly circumstanced two other co-accused, namely, Premlata Devi and Pramod Das have already been granted anticipatory bail by a Bench of this Court vide order dated 28.07.2015 passed in Cr. Misc. No. 29994 of 2015.

Learned counsel for the State does not dispute this

In that view of the matter, for the reasons assigned in the aforesaid order dated 28.07.2015, as contained in Annexure 2 to the present application, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bhagalpur in connection with Kahalgaon P.S. Case No. 111 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
