The petitioner apprehends his arrest in Sahebganj P.S. Case No. 331 of 2014 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The petitioner is alleged to have assaulted the informant with Lathi on his head.

Learned counsel for the petitioner submits that there is a case and counter case. The occurrence took place due to land dispute. Ranjit Thakur the informant of the present case is alleged to have assaulted Kavindra Thakur with Dabiya on his head and one incised wound was found on the head of Kavindra Thakur although the same is opined to be simple in nature, but it appears that Kavindra Thakur gave Pharsa blow on the head of the

Patna High Court Cr.Misc. No.29879 of 2016 (3) dt.17-10-2016 2/2 informant and the petitioner is alleged to have assaulted Ranjit Thakur, the informant with Lathi on his hand. The informant was referred to S.K.M.C.H., Muzaffarpur where X-ray and CT scan was advised, but the investigating officer did not procure the final opinion of the doctor about the injury.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
