JUSTICE RAKESH KUMAR ORAL ORDER 30-06-2016 Heard Sri Pankaj Kumar Sinha, learned counsel, who was assisted by Sri Kamal Kishore Jha, learned counsel for the petitioner and Sri Ram Priya Saran Singh, learned Addl. Public Prosecutor.

The petitioner, who is F.I.R. named accused in K.Nagar ( Sri Nagar) P.S. Case no.556 of 2015 registered for the offence under Section 302 and other allied Sections of the Indian Penal Code, has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner. He further submits that in identical situation, number of accused persons have been granted anticipatory bail.

This Court is of the opinion that if a person is named accused in the F.I.R. , particularly for such serious offence,

Patna High Court Cr.Misc. No.26445 of 2016 (2) dt.30-06-2016 2/2 he is not entitled to privilege of anticipatory bail. Accordingly, this Court is not inclined to grant anticipatory bail to the petitioner. The petition stands dismissed.
