====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 31-10-2018 Heard Sri Y.C. Verma, learned senior counsel, assisted by Smt. Deep Nishi, learned counsel for the petitioner and Mr. S.M. Rahman, learned Addl. Public Prosecutor. Within a short span of time, this is the second attempt for grant of bail on behalf of the petitioner. Recently on 03-05-2018, considering the nature of accusation as well as criminal antecedent of this petitioner, his prayer for bail was rejected vide Cr. Misc. No. 26521 of 2018.
Sri Y.C. Verma, learned senior counsel appearing on behalf of the petitioner tried to persuade the Court to examine the case on merit.
However, since on merit, the prayer for bail of the petitioner was already rejected, there is no reason to again
Patna High Court Cr.Misc. No.51019 of 2018(4) dt.31-10-2018 2/2 examine the same. On the point of change in the circumstances, learned senior counsel submits that during intervening period, charge has already been framed. Meaning thereby that trial has already commenced and, as such, there is no reason to entertain the same prayer.
The prayer for bail of the petitioner stands again rejected.
