JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Manjhaulia P.S. Case No. 168 of 2018 registered for the offences punishable under Sections 341, 323, 498A, 504/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Allegation against the petitioner is of subjecting his wife to cruelty with respect to non-fulfilment of demand and there is also allegation that she was forcing for prostitution. Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and considering the nature of allegation against him, he is not ready to keep her with dignity and care. Patna High Court CR. MISC. No.46352 of 2019(3) dt.01-10-2019 2/2 opposite party No.2 has submitted that she is ready to reside with the petitioner.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to appear before the court below on 16.10.2019, on that day opposite party No.2 shall also remain present in court and learned court below shall extent the provisional bail granted to him by order dated 26.7.2019 for a further period of four months and during that period learned court below shall refer the matter to the District Mediation Centre for amicable settlement between the parties and the District Mediation Centre shall submit report within three months, once the report is received by the court below, on considering the same and after hearing both the parties the court below shall pass an appropriate order either confirming the bail bonds of the petitioner or pass any other order or orders.
