The sole petitioner, apprehending her arrest in Fatehpur P.S. Case no.62 of 2016 registered for the offence under Section 7 of the Essential Commodities Act and Section 406 of the Indian Penal Code, has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that the petitioner is a P.D.S. dealer and is a widow lady. He submits that she has been falsely implicated in the present case and about 4 Quintals of wheat was shown to be recovered alleging violation of provision of Section 7 of the E.C.Act.
Learned Addl. Public Prosecutor has opposed the prayer of the petitioner.

No.26456 of 2016 (2) dt.30-06-2016 2/2 However, considering the nature of accusation and the fact that the petitioner is a lady , let the petitioner, namely, Subhadra Devi, in the event of her arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Fatehpur P.S. Case no.62 of 2016 , subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
