No one appears on behalf of the State.

The petitioner is facing prosecution in Pupri P.S. Case No. 14 of 2016 registered under Section 304B of the Indian Penal Code.

The petitioner is mother-in-law of the deceased. The entire family members including the husband made accused with an allegation that the victim was done to death for non-fulfillment of demand of dowry.

It is submitted that the petitioner is a lady having no criminal antecedent. The other co-accuseds of the case except the husband have been released on anticipatory bail by this Court

Patna High Court Cr.Misc. No.35316 of 2016 (2) dt.19-09-2016 vide order dated 20.05.2016 (Annexure-2). The case of the petitioner stands on identical footing.

Considering the fact that other co-accuseds who are identically placed have been released on anticipatory bail, I direct above named petitioner, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Pupri at Sitamarhi in Pupri P.S. Case No. 14 of 2016 subject to the condition as laid down under Section 438(2), the code of Criminal Procedure with further condition that one of the bailors shall be her own/close family member. The petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel her bail bonds.
