The petitioner apprehends his arrest in connection with Maharajganj P.S. Case No. 166 of 2021 registered for the offences punishable under Sections 30(a)/36/41(i) of the Bihar Prohibition and Excise Act.

There is recovery of 144 litres of illegal wine from the truck not from the conscious possession of the petitioner. Considering the fact there is no recovery from the petitioner and also the fact that the petitioner bears clean antecedent as mentioned in paragraph No. 3 of the petition, the present anticipatory bail application is allowed. Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the
