The petitioner, who is in custody, seeks bail in connection with Jankinagar P.S. Case No. 174 of 2017 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

Informant is the father of deceased has alleged in his fardbeyan that petitioner and his family members set her ablaze for non fulfillment of demand of Rs. 1 lacs as dowry and she was admitted in the hospital in a very precarious condition and thereafter she died on 07.10.2017 and this FIR has been instituted.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this

Petitioner is husband of the deceased and he was not present at the time of occurrence, he was in field and when he knew about the occurrence he immediately came at house and brought the deceased in the hospital but during the treatment she died. She was cooking food and in the meantime fire caught in her sari and due to that she burnt. Petitioner has no criminal antecedent and he is in custody since 11.10.2017. Charge sheet has been submitted.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea, in connection with Jankinagar P.S. Case No. 174 of 2017.
