2. The petitioner is apprehending his arrest in connection with Darpa P.S. Case No. 25 of 2024 dated 02.03.2024 registered for the offences punishable under Sections 379, 411 and 414/34 of the I.P.C.
3. As per the prosecution case, the petitioner and the co-accused are alleged to have committed theft of 48 bundles of aluminum wire which were recovered from a pick-up van. The co-accused further disclosed that the petitioner Tarique Anwar and 4-5 unknown accomplice committed theft of electricity wire in night. The co-accused
Patna High Court CR. MISC. No.46129 of 2024(2) dt.13-09-2024 2/3 disclosed that he the petitioner Tarique Anwar and others committed theft of electricity wire in the previous month which he loaded on his pick-up van and carried it near Chhatauni Bus Stand, Motihari.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The other coaccused person has already been granted bail by this court vide order dated 09.05.2024 passed in Cr. Misc. No. 33574/2024. The petitioner has one criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner. 6.
Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of eight weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Motihari, East
Patna High Court CR. MISC. No.46129 of 2024(2) dt.13-09-2024 3/3 Champaran in connection with Darpa P.S. Case No. 25 of 2024, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
