Three petitioners, apprehending their arrest in connection with Mahakar P.S. Case No. 27 of 2016 registered for the offence under section 342/ 323/504/ 34 of the Indian Penal Code and Section 3(i)(x) of the Scheduled Caste /Scheduled Tribes (Prevention of Atrocities ) Act , have prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioners that from perusal of the F.I.R. there is no element of commission of offence under the SC/ ST Act. He submit that in the F.I.R. there is general and omnibus allegation that the accused persons abused the informant's side. On this very he has made a prayer
Patna High Court Cr.Misc. No.26503 of 2016 (2) dt.30-06-2016 2/2 for grant of anticipatory bail.
Besides hearing learned counsel for the parties, I have also perused the F.I.R. On going through the F.I.R. I do not find any ground to entertain the present anticipatory bail petition. The petition stands dismissed.
