The petitioner is languishing in custody for the offence punishable under Sections 147, 148, 149, 448, 341, 323, 307, 354, 379, 504 and 506 of the Indian Penal Code. Later on Section 302 IPC was added.

The F.I.R. does not show that the petitioner is one of the assailant of the deceased rather the petitioner and others assaulted to some other person.

Learned counsel for the informant opposed the prayer for bail on the ground that the witnesses before the police have stated that the petitioner had also assaulted to the deceased. There is no reason for suppression of the aforesaid fact in the F.I.R. Petitioner is in custody since 26.04.2020.

Patna High Court CR. MISC. No.38493 of 2020(2) dt.23-02-2021 2/2 Investigation of the case is already complete. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Didarganj P.S. Case No. 05 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
