The husband of the deceased who is facing accusation punishable under sections 304-B/201/34 IPC, has filed the present application seeking anticipatory bail. Within four years of marriage the victim lady was done to death wile she was in matrimonial home.
The contention of the petitioner is that she was afforded medical assistance and while being carried to PMCH for better treatment, she died.
Learned APP, on the other hand, opposed the prayer and submitted that the petitioner being the husband is responsible for upkeep of his wife. The dead body of the deceased was not
Patna High Court Cr.Misc. No.43938 of 2015 (2) dt.13-10-2015 2/2 presented for post mortem.
Considering the allegations attributed to the petitioner, I am not inclined to enlarge him on anticipatory bail. His prayer for bail is rejected. The petitioner should surrender and pray for regular bail in the court below which shall consider his case on its own merit and dispose of the same in accordance with law.
