The petitioner apprehends his arrest in a case registered for offences punishable under Sections 147, 149, 341, 323, 379, 307, 506 and 504 of the Indian Penal Code.
It is contended on behalf of the petitioner that though there is allegation that the petitioner has assaulted on the brother of the informant Vijay Sharma by Kudal (spade) but the injuries are superficial and simple in nature. The allegation is that the petitioner has also assaulted the sister-in-law (bhabhi) of the informant along with Ram Rup Das but only abrasion on the right wrist has been found upon the aforesaid Neelam Devi being
Patna High Court Cr.Misc. No.26134 of 2016 (2) dt.30-06-2016 2/2 simple in nature. It is further contended that it is evident from the First Information Report that altercation took place due to dispute with respect to the land between the parties. Petitioner claims that his antecedent is clean.
Having regard to the aforesaid facts and circumstances of the case, let the petitioner Laloo Das @ Lalo Das be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Bhargama P.S. Case No. 15 of 2016 on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure. However, at the time of furnishing bail bonds the court below would verify the criminal antecedents of the petitioner and if he is found involved in any criminal case before the date of passing of this order then he would be taken in custody.
