JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The petitioner seeks regular bail in connection with K. Hat (Sahayak) P.S. Case No. 366 of 2017, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 7 litres of foreign liquor. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has been in judicial custody since 06.06.2017 and so far one criminal antecedent is concerned, he is on bail in that case.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and also the fact that petitioner has criminal antecedent as he is an accused in similar type of case, as

No.38066 of 2017 (3) dt.24-08-2017 such, this application is disposed of with direction to the court below to expedite the trial and try to conclude it within a period of two months and if the trial is not concluded within the aforesaid period, the court below shall release the petitioner on bail to his own satisfaction.
