This is an application for bail in connection with Rahui P.S.Case No. 75 of 2017 registered for the offences punishable under Sections 363, 364, 302, 201 and 120B of the Indian Penal Code.
Petitioner is not named in the FIR and his name transpires during course of investigation and, that too, on suspicion.
Submission of learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and it has come during investigation that earlier to the occurrence the petitioner has met with the deceased and further submission is that prior to involvement of the petitioner the villagers have lodged a case against the informant and others with respect to assault and for that he has been made accused in this case and now he is in
Patna High Court Cr.Misc. No.36507 of 2017 (3) dt.30-08-2017 2/2 custody for four months having no criminal antecedent. Heard learned APP also.
Having heard both sides and in view of facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Rahui P.S.Case No. 75 of 2017, subject to the conditions that :- (i) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) petitioner shall co-operate in trial and appear in court on each and every date fixed and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
