JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-01-2021 Heard Mr. Krishna Prasad Singh, learned senior counsel for the petitioner and Dr. Mritunjay Kumar Gautam, learned Additional Public Prosecutor for the State. The petitioner seeks bail in connection with Danapur P.S. Case No.430 of 2020 registered under Section 376 of the Indian Penal Code.
Considering the gravity of the offence and the allegation made by the informant that in absence of her husband, the petitioner forcibly ravished her and the informant has supported the allegation in her statement made under Section 164 of the Code of Criminal Procedure, I am not inclined to grant him bail. His prayer for bail is rejected. Learned Additional Chief Judicial Magistrate-1st,
Patna High Court CR. MISC. No.34410 of 2020(2) dt.22-01-2021 2/2 Danapur is directed to commit the case of the petitioner after complying the provisions prescribed under Section 207 of the Code of Criminal Procedure to the court of session without any delay. Once the case is committed to the court of session, the learned Sessions Judge, Patna shall be required to ensure speedy trial of the petitioner.
