The petitioners apprehend their arrest in Goraul (Kathara O.P.) P.S. Case No. 02/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code.
The petitioner Ramakant Sah is alleged to have assaulted Gurdayal Sah with sword and consequently the finer of Gurdayal was severed. Ganpat Sah is alleged to have assaulted Ganesh Sah with Pharsa on his head and Ranjeet Sah is alleged to have assaulted Meena Devi with iron rod.
The injuries found on the persons of Ganesh Sah and Meena Devi is simple in nature. There is a land dispute between
Patna High Court Cr.Misc. No.44859 of 2015 (3) dt.22-12-2015 2/2 the parties.
Considering the facts aforesaid, petitioner no. 2 Ganpat Sah and petitioner no. 3. Ranjeet Sah, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Hajipur, Vaishali in connection with Goraul (Kathara O.P.) P.S. Case No. 02/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
So far as petitioner no. 1 Ramakant Sah is concerned, he is alleged to have assaulted with sword on the hand of the informant causing cutting of finger of the informant, injury found on the hand of the informant is grievous in nature, I am not inclined to enlarge the petitioner no. 1 Ramakant Sah on anticipatory bail.
