The petitioner seeks bail in Sidhawalia P.S. Case No. 26 of 2021, Trial No. 05 of 2021, registered for the offence under Section 25(1-b)a / 26 of the Arms Act and Section 8(c) / 20(b)(ii)(B) of the N.D.P.S. Act.

It is submitted on behalf of petitioner that petitioner has been made accused in this case on the disclosure made by two co-accused, who were apprehended on spot with arms and ganja. Neither petitioner was arrested on spot nor any arms or narcotic drug has been recovered from his possession. Petitioner is in custody since 29.06.2021. Chargesheet has already been submitted.

Patna High Court CR. MISC. No.51938 of 2021(2) dt.27-01-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-1 cum Special Judge (NDPS), Gopalganj in connection with Sidhawalia P.S.
