JUSTICE BIRENDRA KUMAR ORAL ORDER 11-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending her arrest in connection with Katihar Muffasil P.S. Case No. 159 of 2018, registered for the offence punishable under Section 366A/34 of the Indian Penal Code.
The victim girl, aged about 15 years, has stated in her statement under Section 164 Cr.P.C. that the petitioner and coaccused Girja Devi lifted her and they stated that they would get her married. The victim started crying. In the meantime, the police came and took her to police station and handed over her to the parents.
Considering the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the
Patna High Court Cr.Misc. No.52196 of 2018 (3) dt.11-10-2018 P2/ petitioner. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within three weeks, the prayer for regular bail shall be disposed of without being prejudiced by the order of this Court.
